Flexify processes the beforementioned information where it is necessary for the adequate performance of the contract and given our legitimate interest in improving Flexify services and our Users’ experience with the website.

Third party processors have limited access to your information to perform tasks to improve Flexify services or to adequately perform contractual obligation. Flexify only with U.S. based processors that are EU-US Privacy Shield certified, and where the processor that are located outside the EEA, Flexify is committed to transparency principle as required by the GDPR and processes customers’ data only in countries that provide an adequate level of protection in the light of GDPR requirements.

Your rights

You have a legal right under GDPR and any relevant UK legislation to a copy of all the personal information about you held by us. On request, we will provide you with a copy of this information subject to a fee not exceeding £10. You also have a right to correct any errors in that information. As mentioned above, you have a right to prevent the use of your personal information for direct marketing purposes.

Under the GDPR, You are allowed to exercise certain rights in relation to your Personal Data. These rights include:

  • You can ask to receive certain information about Flexify’s processing activities (right to be informed). You have also a right to be notified in the (unlikely) case of a Personal Data breach which could result in high risk to your rights and freedoms.
  • Data Subjects can request access to the Personal Data that Flexify holds on them through a “Subject Access Request” (SAR). You can email Flexify at hello@flexifyhq.com.
  • You can request that Flexify changes inaccurate or incomplete data (right to rectification)
  • Data Subjects can ask Flexify to erase Personal Data if it is no longer required for Flexify to hold it for the purposes for which it was collected or processed. This is known as “the right to be forgotten”;
  • You can restrict processing of their Personal Data in specific circumstances, and prevent processing of their Personal Data that is likely to cause damage or distress to you or anyone else;
  • You can, in limited circumstances, receive or ask for their Personal Data to be transferred to a third party in a structured, commonly used and machine readable format (data portability)
  • You can withdraw their consent to the processing of their Personal Data at any time (the right to object); prevent Flexify’s use of their Personal Data for direct marketing purposes; challenge teh processing of their Personal Data which has been justified on the basis of Flexify’s legitimate interests or in the public interest; and make a complaint to the ICO;
  • Data Subjects can object to decisions by Flexify based solely on Automated Processing of their Personal Data, including profiling; currently Flexify takes no decisions on such basis.

Retention Period

Flexify retains your personal information for as long as is necessary for the performance of the contract between you and Flexify or to comply with legal obligations. In any case, we do not retain data for a period exceeding 6 years as prescribed by UK law. If you no longer want us to use your information, you can request that we erase your personal information.
